法務部陳定南部長在美國州檢察長協會2004年夏季年會發表演講

法務部新聞稿 九十三年六月十八日 法務部陳定南部長在美國州檢察長協會2004年夏季年會發表演講 美國州檢察長協會2004年夏季年會特別邀請法務部陳定南部長以貴賓身分,在「州宴」(State Dinner)中第一位上台致詞,陳定南部長以「不同制度,共同目標」為題,簡潔扼要地說明兩國的司法制度雖有不同,但都以實現正義為共同目標,並強調雙方自2002年三月間簽署刑事司法互助協定以來,兩國在打擊犯罪的合作上,建立了更堅強穩固的基礎,這二年來,雙方相互請求協助調查跨國刑事案件的次數愈來愈多,大會近幾年來所關切的強化刑事司法功能、反恐怖行動、打擊電腦犯罪、對抗藥物濫用、防制盜用身分資料及確保個人資料安全等工作重點,也都是近幾年台灣在對抗刑事犯罪上的重點工作。甚至美國政府極為關切的智慧財產權、毒品及洗錢犯罪的防制,也是台灣檢察部門向來極為重視的重點工作,並在近幾年與美國執法部門有密切的合作,也創造了極佳的查緝績效。相信秉持「不同制度,共同目標」的信念,是促進世界合作最有效的捷徑。 美國州檢察長協會的「州宴」是此次年會的重要宴會,比開幕式還要正式隆重,除各州檢察總長出席外,並有眾多專家學者出席,場面浩大,陳定南部長是中華民國第一位受邀在美國州檢察長協會年會「州宴」上致詞的法務部長,顯見該協會肯定陳部長於法務部長任內在打擊刑事司法犯罪及推動中美刑事司法互助所做的努力,也為台美司法交流的推展更向前邁進了一步。 (附陳部長中英文致詞稿全文及部長贈紀念品予NAAG,由該協會Lockyer會長代表接受照片乙張) Different Systems, Common Goals Speech at NAAG’s Summer Meeting Held at Fairmont Hotel, Santa Monica, Los Angeles, California June 17, 2004 By Ding-nan Chen Minister of Justice Taiwan President Lockyer, Distinguished Attorneys General, Ladies and Gentlemen: It is my great honor to attend the 2004 NAAG summer meeting. I am especially glad to meet again with Attorney General Edmonson of Oklahoma, Attorney General Renkes of Alaska, Attorney General Brady of Delaware, Attorney General Baker of Georgia, Attorney General Moylan of Guam, and Attorney General Stenehjem of North Dakota, Soon after their visit to Taiwan five months ago. As far as I know, the NAAG has effectively promoted the environment of cooperative leadership and sustained the high quality of legal services. Its achievement is evident to all. Taiwan has sent a delegation under the leadership of the Prosecutor General or Chief Prosecutor to the annual summer meeting ever since 1987. At the same time, the NAAG has also sent missions to visit Taiwan. During the previous four years of my service as Minister of Justice, two such missions have called on us. I am positive that such intensive exchange of missions and visits has contributed much to our friendship and mutual understanding. Although Taiwan follows the civil law system, which is different from your common law system, both of us are invariably striving for justice. As a result of intensive interaction and the frequent economic and cultural exchange between our two peoples, the recent enactment and revisions of many of our laws have been deeply influenced by the American legal system. Taking the revision of the Code of Criminal Procedure for example, we have obviously been shifting from the inquisitorial system toward the adversary system. Since our two countries signed the Agreement on Mutual Legal Assistance in Criminal Matters (MLAA) in March of 2002, we have laid a strong, stable cornerstone for cooperation in the fight against crime. In the past two years, America has requested assistance from Taiwan in criminal investigation of 12 cases, whereas Taiwan has requested that America assist with seven cases. I strongly believe that such exchanges and cooperation will increase with time in the future. Under the common goal of ensuring justice, the criminal policies of the United States and Taiwan bear many similarities. Many of your recent concerns, such as the commitment to criminal justice, anti-terrorism initiatives, fighting computer crime, combating drug abuse, preventing identity theft and ensuring information security are also our priorities in cracking down on criminal offenses. Moreover, the topmost US concerns, such as combating IP infringement, drug trafficking, and money launder, are also the topmost aims of the effort of our law-enforcement agencies. In this respect, we have established close cooperation with American law-enforcement agencies and have obtained great results in the criminal crackdown. I believe that despite different systems, adhering to the common goals is the best, most effective approach to world cooperation. In closing, I wish the meeting great success and every one of you prosperity and good health. At the same time, I warmly welcome you to visit Taiwan at your earliest convenience to introduce you to the beautiful scenery and unique culture of Taiwan. During your trip, you will also have an opportunity to experience the cordiality and hospitality of our people. Lockyer會長、各位檢察長、各位女士、先生:大家晚安! 承蒙全美州檢察長協會盛情邀請,得以親臨貴協會2004年夏季年會,本人深感榮幸。尤其在這次年會中能與Oklahoma州Edmonson檢察長、Alaska州Renkes檢察長、Delaware州Brady檢察長、Georgia州Baker檢察長、Guam州Moylan檢察長及North Dakota州Stenehjem檢察長等人再度聚首,令人倍感親切與興奮。 據我所知,在美國州檢察長協會的統合協調之下,不但有效的促進各州間的共同領導環境,並普遍的提昇各州的法律服務品質,其績效之卓著,乃有目共睹。臺灣從1987年起,每年均指派檢察首長組團參加貴協會的夏季年會;而貴協會亦組團來台訪問,在我部長四年任內即曾來訪兩次,相信經過雙方密集的實地觀摩及意見交換,對增進彼此友誼及相互瞭解必然有相當大的助益。 臺灣雖然是一個實施大陸法系的國家,與美國所實施的英美法系有相當大的差異,但我們的共同目標均同樣在實現正義。尤其在兩國人民密切的互動及頻繁的經濟、文化交流影響下,臺灣最新制定或修正的許多法律也受到美國法制的深切影響,例如具有濃厚職權主義色彩的刑事訴訟法,最近的修正已明顯朝向美國當事人進行主義的方向發展。而美國與臺灣自2002年三月間簽署刑事司法互助協定以來,更使兩國在打擊犯罪的合作上,建立了更堅強穩固的基礎。這二年來,美國向臺灣請求協助調查的刑事案件共有12件,臺灣請求美國協助調查的刑事案件共有7件,相信雙方未來的交流與合作必定會與日俱增。 在實現正義的共同目標之下,近幾年美國與台灣的刑事政策也有許多相同的重點,例如:貴協會近幾年來所關切的強化刑事司法功能、反恐怖行動、打擊電腦犯罪、對抗藥物濫用、防制盜用身分資料及確保個人資料安全等工作重點,也都是近幾年台灣在對抗刑事犯罪上的重點工作。甚至美國政府極為關切的智慧財產權、毒品及洗錢犯罪的防制,也是台灣檢察部門向來極為重視的重點工作,並在近幾年與美國執法部門有密切的合作,也創造了極佳的查緝績效。我們相信,秉持「不同制度,共同目標」的信念,是促進世界合作最有效的捷徑。 最後,敬祝大會圓滿成功,各位事業順利、家庭美滿,並竭誠的歡迎各位檢察長在公忙之餘,能撥冗到台灣參觀訪問,讓我們為各位介紹台灣的自然美景、獨特文化及體驗台灣人民濃郁的人情味。 對於貴協會多年來盛情接待,在此謹代表法務部致贈精美紀念品,聊表謝意。 謝謝大家!
