The 2nd round cross-strait negotiation of the cross-border telecom fraud cases

After first negotiation with cross-border telecom fraud like Kenya case between governments cross-strait in April 21, the Director General of Department of International and Cross-Strait Legal Affairs, Ministry of Justice, Chen Wen-chi, leaded prosecutor Meng Yumei and section manager Lai Shipeng, Taiwan High Court Hualien branch Public Prosecutor's Office prosecutor Zhang Chunhui, Taiwan Taoyuan District Court Public Prosecutor's Office Chief prosecutor Fan Zhenzhong, Taiwan Taichung District Court Public Prosecutor's Office prosecutor chief prosecutor Lin Bohong, Mainland Affairs Council Law and Politics Department deputy director Zhouming Rui and commissioner Cheng Zhengxing, Straits Exchange Foundation Legal Department deputy director Zhang Fengqing, Ministry of the Interior National Police Administration Criminal Police Office captain Guo Youzhi, Police Zhang Jiabang and investigator Zhang Liyuan, et al.. During the night at Guangdong Province Zhuhai city in May 12nd, they start second negotiation with China Ministry of Public Security. Mr. Chen Zhimin, deputy minister of the Ministry of Public Security, leaded the team from Beijing and met with our delegation formally at Zhuhai city. During the meeting, we stressed the importance of cross-strait cooperation in cross-border telecom fraud investigation. DG Chen Wen-chi said that Taiwan High Court Public Prosecutor's Office had established cross-border telecom fraud stolen property (goods) tracking platform to strengthen our ability regarding stolen property tracking, investigating and transferring. In the same time, we asked Mainland China to provide the documentary evidence of Kenya and Malaysia case. In the morning on May 13rd, our delegation went to Zhuhai city First and Second Detention Center visiting Taiwanese suspects of the Malaysia case. Five people who had hired lawyers and other fifteen people asked for legal aid. All of 29 suspects were in good physical condition. One of them had been brought to Hospital because of physical discomfort. Two of them received drug treatment because of Arrhythmia. In the afternoon, both sides discussed about Kenya case and the family visit issue. DG Yang Dong, Criminal Investigation Department of the Ministry of public security was the chief negotiator and accompanied by Deputy DG Chen Xiaokun, Taiwan Affairs Office Board regulations Secretary Zhang Wanming, Ministry of public security Hong Kong, Macao, Taiwan Office director Li Jiang Zhou, General office deputy director, Criminal Investigation Department and Criminal Investigation Corps members, Beijing Public Security Bureau deputy director, Haidian Branch deputy director, Guangdong Province Public Security Criminal Investigation Department, Zhuhai city Public Security Bureau, et al.. In the morning on May 14th, both sides discussed about Malaysia case and both cases problem. DG Sun Lijun, Ministry of public security State Security Bureau was the chief negotiator and accompanied by DG Yang Dong, Criminal Investigation Department of the Ministry of public security, Deputy DG Chen Xiaokun, Taiwan Affairs Office Board regulations Secretary Zhang Wanming, Ministry of public security Hong Kong, Macao, Taiwan Office director Li Jiang Zhou, General office deputy director, Guangdong Province Public Security deputy director, Guangdong Province Public Security Criminal Investigation Department secretary, Zhuhai city Public Security Bureau secretary, deputy director and Investigators. The following achievements were reached: 1. Our delegation was reported the situation about circumstances of the crimes, criminal organizations, people involved and Investigating progress of Kenya and Malaysia case by explanation from China side. Kenya case had been investigated, so it was sued by Procuratorate. 2. Both sides exchanged some evidence and information of these two cases. We got the transcript of the statements by the Chinese victims. 3. Both sides assigned contact person for the continuous corporation in these two cases. 4. The delegation visited Taiwanese suspects in custody via video conference. 5. For the cooperation method in the future, we achieved the following consensus: I. Mainland side agreed that they would arrange family member visit to Taiwanese suspects based on the Cross-Strait Joint Fight against Crime and Mutual Legal Assistance agreement II. Both sides will depend on investigating progress and then exchange the information in relation to Kenya and Malaysia case. Afterward, they will track down accessories at large together. III. Both sides agreed that they will cooperate in tracking, investigating and recovering of stolen property to make up the loss of victims. IV. Both sides will discuss the concurrent jurisdiction issue of cross-border crime after the investigation is completed. Today(14th), the delegation had arrived Taiwan as scheduled at night.
