Taiwan enacted The Transfer of Sentenced Persons Act on July 23 2013. Subsequently, Taiwan and Germany signed the Arrangement on the Transfer of Sentenced Persons and Cooperation in the Enforcement of Penal Sentences on October 23 and November 6, respectively, in the year 2013. This Arrangement is Taiwan’s first bilateral judicial cooperation arrangement with European country, establishing a mechanism for transferring prisoners between Germany and Taiwan on an equal and reciprocal basis. Subject to certain conditions agreed by both governments, the inmate with his/her own willingness will be granted to return to their home country to continue the enforcement of the rest of the sentence. The transfer of sentenced persons facilitates the process of rehabilitation and in mates’ return to society. In February 2015, one of the German inmates serving their sentence in Taiwan was successfully transferred back to Germany to serve the rest of his sentence in accordance with this Arrangement.
